Pre-Nuptial Agreements

When a marriage ends, one of the biggest worries is not knowing what will happen to the family home and how any assets and debts will be divided.  To minimise any uncertainty, a growing number of people are choosing to enter a Pre-Nuptial Agreement before they marry.

This particularly seems to be the case for people who have been married before, who wish to ensure that any children they already have will be provided for and that their assets are protected.

Pre-Nuptial Agreements have an odd status in English law.  They are not recognised in legislation and their status has evolved through the outcomes of a number of landmark Court cases.

The law does not allow Pre-Nuptial Agreements to supersede the authority of the Courts.  This does mean that a Pre-Nuptial Agreement could be overturned if the Court did not feel it was fair.  However, the Courts will take a Pre-Nuptial Agreement into consideration and the Court may not allow the parties to depart from this if they both went into it fully aware of each other’s financial circumstances and both had the benefit of independent legal advice.


We offer a fixed fee of £1,000.00 plus VAT to prepare a Pre-Nuptial Agreement.
